Case Law Analysis – Contract Law
I have revised a contract appeal case heard by the Supreme Court of New Mexico on
April 10
th
, 1980 by Justice Payne. The case is about a couple who claimed their rights of
revocation against a business with a subject matter of a mobile home. The original defendant
brought the case before the court arguing the definition of “reasonable time” for revocation and
asking the Supreme Court for their interpretation of the law.
Basics of the Case
On March 11
th
, 1974, Modern Trailers Sales Inc., (the defendants) supplied the plaintiffs,
Rudy and Carmen Ybarra, a new double-wide mobile home. Several days after supply, the
plaintiffs noted portions of the floor had begun to rise and bubble. The trial court found that the
defects indeed existed but were not visible at the time of supply.
The plaintiffs notified the defendants immediately of their complaints when they noted
the defects and asked for an immediate correction. Without any questions, the defendants sent
repairers to correct the situation on three times, but they didn’t manage to correct the situation.
The district court is hearing the original case found in favor of the plaintiffs claiming they
appropriately revoked the contract under the terms of New Mexico state law requirements.
The Dispute
On September 4
th
, 1975 the defendants made their last attempt to repair the floor, but
argue that they never heard from the plaintiffs again until being served with the original request
for cancellation. The defendants claim that they were not given enough time to remedy the
situation. The plaintiffs, on the other hand, argue that they pursued the defendant with their
grievances and to request them to honor their verbal agreement that they were willing able to fix
