The use of guns and the way of controlling use of guns has become a challenge in the
United States of America. The policies that the U.S government has introduced will decrease the
number of deaths that are usually caused by the use of guns. Use of guns in schools have been a
point of concern over years. Many ideas have developed on the legitimacy of the use of guns in
the schools by the teachers. In this research, I will strive to research on the possible causes of
shootings in schools and all the legal issue that can relate to the legal issues. The issue of weapons
has been a point of concern in the countries over time. The weapons in the community can cause
unnecessary assault that would affect the citizens of the country. Lack of policies on gun control
and the way gun users use them has increased the killings of the citizens of America as compared
to other countries. This increase in murder cases, is despite the fact that American has a lot of guns
that can be used for security by its citizens.
The availability of gun enables citizens to be safe from their enemies. Just like in the case
United States v. Cruikshank in 1875 that involved Ku Klux Klan, the United States government
has proposed the use of firearms by teachers in school. In the case, the use of firearms was needed
to offer protection to the people and never to harm any person in the country. Teachers will use
the guns to protect themselves from hostile students and their enemies. This will enable the hostile
students to have a fear of their teachers, and this will promote safety among the teachers in the
country. All the restrictions that are placed in the community will aim at safeguarding the lives of
the teachers and the pupils in schools. The project will need to answer many questions that relate
to the legal implication of school shooting.

An incident of mass shooting occurred in 14

February 2018 whereby a former students
fired utilizing the Semi-Automatic AR-15 rifle in Florida. The firing was done in the Marjory
Stoneman school. During the firing incidents, there were 17 people who were killed and 15 people
were seriously injured. From the incident, the students of the school had to react and develop a
social Activism where the slogan of “Never Again” was developed.
Another incident of school shooting had also occurred in2012 in Sandy Hook. In the area,
there are more than 239 shootings in schools that have occurred. The shootings have led to killing
of many teachers and pupils in schools. The shooting has therefore led to a lot of debate in social
media on the way the issues can be rectified. In the political debates, there are many people who
saw that the second amendment act had become a great obstacle to the control of guns but the
decisions from the supreme court has offered a space that would ensure that the government
develop policies and departments to control the use of firearms in the country.
School shootings in America has frequently occurred over time. In 2015, an attack occurred in
Milwaukee whereby 3 people sustain serious injuries. In the same year, 2015 on 24

May, a school
shooting occurred in Michigan whereby there were seven people who were injured. There were
two men who have since then been charged for the incident in school. On 14
th
September 2015, a
school shooting occurred in Sacramento in California whereby one person was killed and two
others were injured. A more dangerous issue of school shooting occurred in Roseburg in Oregon
whereby 10 people were killed and nine were injured. The shooting occurred in Umpqua College.
Another shooting occured in Great High school on 20

March 2018. During the shooting, two

people were killed and one person was injured. In 20

April 2018, another issue occurred in Florida
in the Forest High school where one person was injured.
Research has shown 48% of the firearms in the world are owned in the United States of
America. The research has further indicated that there are about 33000 faculties of firearms. The
rate shown that about 90 deaths will occur daily due to the issue of firearms in the country.
Besides,53% of the victims are usually black people. From this, the presence of firearms in the
country has led to increase in injuries and death both at homes and schools.
Second Amendment Act
The research will be based on the analysis of the second Amendment bill of rights. The
amendment act will play a key role in the protection of the human rights in the country. The act
was adopted to be part of the instrumental Bill of rights in the United States of America in 1791.
The amendment act has indicated that the rights of an individuals are never unlimited and has
never prohibit the utilization of firearms or other devices as shown in that case Lewis v. United
States of 1980. In the case the congress of the United States of America may play a role in the
prohibition of felony from having guns at their discretion. The guns in this case should not just be
held but should play a role in the protection of the citizens. The amendment act therefore has
played a role of keeping arms as it has been influenced greatly by the Bill of Right of England.

Research objectives.
With the utilization of the bill of rights, the project will seek to answer many research question
in the world on gun control. The research questions that are set to be answered will include the
following;
Banning the use of weapons by non-militant will reduce cases of shooting in schools under
the given Emergency Management law?
What is the age of gun ownership is raised to become 21 years? Will the step have any
control on the gun shooting in schools?
What if teachers are armed with guns? Will the step have any influence on the shooting in
schools?
What are the proper solutions that can be offered by the Emergency Management
Department on gun control in schools?
Should teachers be allowed to carry guns or weapons to schools? If yes, what are the proper
consequences of the act and what gun types should they carry?
Who will be responsible for the training of teachers on safety use of guns in schools so as
to reduce the school shooting?
What bodies have been set up by Emergency Management Department to check on the
issue of gun control in the community?
What if the guns cause a liability in schools? Who will be liable for the liability?
Should the parents allow the teachers to carry guns to schools?
What if a teacher with a gun becomes hostile to his or her colleagues?

What if the students are accidentally shot in schools? What will the parents do? Will they
accept a waiver?
The research questions above will be answered in the research utilizing the Second
Amendment Act that allows use of firearms. There are many ways in which the government can
benefit its teachers on the use of weapons as offered by the Act

. The process of buying weapons
is intense, and it is difficult for teachers as it also entails the views of the parents of the students.
The parent need to reassess the need for a teacher having a gun in school and always be ready for
accidents just as it has been indicated in the case of District of Columbia v. Heller of 2008. In the
ruling that was delivered by the court based on the second Amendment act, people can possess the
firearms that are not at all connected to militia services. The case allowed the use of guns in all the
lawful ways for possible self-defense. The parents will also need to be very ready to sign a waiver
in case of any accidents

to the students, but it should also help in protecting them. Each teacher is required by the
government to acquire a gun license from the police stations and the weapons that seems unsuitable
for the teachers should be withdrawn by the government. The government should be compensated
by the teachers who are in possession of guns, and this will enable the government not to contribute
to the debt that the country has. The government should not do unlawful raids by the police and

In the United State of America, many weapons are possessed by citizens including teachers.
The possession of this weapons will enable protection to them. There are some of how the U.S
government can eradicate the possession of the illegal weapons possessed by the public. The best
example is searching for suspicious people in the streets. This increase the possibility of police to
find guns that are illegally owned by unlicensed citizens. Searching for people can cause biases
among the police officers and the citizens. This will enable the police officers to be questioned and
accused of this behavior.
People will always find ways of acquiring weapons to commit crimes, and this will be
difficult for the government to eradicate the possession of illegal weapons. Just as by the case of
McDonald v. City of Chicago of 2010 , the guns will need to be prohibited if it has greatly been
used to commit crimes in the community. The act by the government on avoidance of illegal
weapons will only reduce the possession of illegal weapons and cannot fully eradicate.
The case United States v. Verdugo-Urquidez of 1990 has postulated that citizen need to be
saved in the community. The case involved the non-resident aliens as well as the Fourth
Amendments where by people who are not citizens of the country will not access licensed guns.
The citizens of the country will need to be safe with or without the guns in the community. This

act by the government prevents citizens from facing threats from their enemies as they will have
nothing to protect themselves together with their students

. The possession of weapons can make
most citizens to abuse the right of self-defense as an excuse for committing murder. The abuse
could also be done by the teachers if they are given an opportunity to take them to schools. Besides,
the case of Lewis v. United States of 1980 has indicated that the possession of guns helps in
frightening of intruders, and it created protection for the citizens.
Many citizens suffer housebreaking from enemies each year due to lack of weapons to
protect themselves. A gun is used to scare away the assailants in such situations and to protect the
citizen. Citizens should be allowed to act in a dead, threatening manner to the assailants to act as
a lesson to others. Attack by gangsters is another problem in some of the cities in the United States
of America. Innocent citizens should be armed to protect themselves from such incidence. The
protection that every citizen is given is through legally obtained weapons that some of the citizens
possess. From this case, the question that a rise is that, as a citizen of the USA will it be good for
the teachers to possess guns in schools? The legal analysis has been done to strive to offer a
solution and the impact of the guns if allowed in schools.
According to my thoughts, it is good for teachers to obtain guns, rifles and other tools that
can be used for protection just as case of Lewis v. United States of 1980 strived to achieve. If this
was to be taken into action, the government should give policies such that teachers who misuse
their guns be judged in court and arrested. This would enable the safety of each teacher. Parents
should be aware of the possession of firearms by teachers, and there have a right to go against it if

in case it affects the performance of their children. Parents should also support the provision of
guns to teachers as this would help in the protection of their children from possible harm. This will
also promote obedience by hostile students to their teachers.
People with licensed guns should use it to protect their families. As postulated in the case
of Caetano v. Massachusetts of 2016 , the people who use this guns should not be judged as it is
right according to the Constitution on the second amendment. People who steal weapons from
others and uses it in committing crimes should be arrested. The government authority needs to
introduce ways in which crimes are dealt with in the community. Gun should be used in the
protection of citizens and possession of guns by teachers in school should be used in the protection
of students together with the protection of their life from enemies. Strong regulations by the
government on the use of guns will make the innocent citizens suffer.
Gun control has a lot of challenges to citizens especially in the United States of America.
Besides, acquisition of guns as by the case of United States v. Miller in 1939 will never guarantee
Safety. The most cause of death that is not natural in the United States of America use of firearms.
The existence of the second amendment helps in protection of human rights and create policies on
the purchasing and possession of firearms

through firearms, and this has enabled most of the citizens to possess a firearm that will protect
himself or herself. This has made guns to be part of equipment’s that a person possesses. Misuse
of firearms is dangerous as it causes deaths to those who misuse them and also to those who do
not know how to properly use it. Guns itself does not kill, but the irresponsible people use them to

misuse of guns that resulted to deaths in the country. From this, every citizen should have gun
control to reduce the number of deaths that are caused by firearms.
The second Amendment of the bill of rights privileges citizens the chance to handle and
possess firearms just as in the case of United States v. Warner of 1993. The people which have
been licensed to handle the guns need to possess the machine and should never transfer its
ownership. At times we may have the thought that this statement of the right to possess and keep

purchase. The government should be the one who will take action on the banning of guns.
The gun is not a basic need and citizens can live without it and be safe.
The United State has a bill of rights that has rights that are guaranteed to every citizen that lives in
the country. The second amendment of the U.S states the citizens has a right to possess

Also, the people who are to possess firearms should be normal and knows the use of a gun. The

government pass a law to ban the possession of a gun. They see it as unconstitutional to ban
firearms as the second amendment constitutes it. People who own a gun encounters a lot of

This will enable avoiding the misuse of guns by the people who possess.

protection. Citizens should be licensed small firearms that are easy for them to carry and that do
not require difficult skills in operating them. On the proposal about the possession of firearms by
teachers, the possession of small firearms is needed to enable them to carry. This will not disrupt
their work as small firearms are easy to carry and do not require a lot of skills in operating.
Teachers should carry concealed weapons in schools. This will avoid fear by the students. Fear by

that have been licensed in using firearms should hide the gun from their students.
There have been a lot of instances that the government has put on the restrictions of guns and the
manufacturing of guns. An example is restrictions on a machine gun.
The government has made a restriction on increasing tax that is paid during the selling of
this firearm

Firearms Act. Another restriction is the registration of the gun by the Federal Bureau of Alcohol,

weapons like a machine gun. Also, explosive are allowed to be used. Weapons that are dangerous

weapons are suitable for wars. These dangerous weapons are legal to buy in the United States of
America.
Weapons such as machine guns are usually used in wars as it is designed as a military
weapon to be used by well-trained individuals. A machine gun is sturdy, large and dangerous and
this makes it usually serves for harmful intentions such as fighting terrorism. The person who
walks with a machine gun is accompanied by magazines that are loaded to enable quick and easy
reloading.

Assault weapons are very hazardous, and to conferring to trial legislation, its validity is
