In Personam Jurisdiction
State Courts have an array of definitions that enable them to exercise their authority in
law enforcement. Importantly, courts are mandated to provide a legal determination of cases
across wide areas that surpass their jurisdictions due to the common nature of the law. The case
study presents a legal dilemma concerning a court’s ability to exercise in personam jurisdiction
on defendants due to an accident within the court’s jurisdiction. While the defendants are non-
residents in the State where the accident has occurred, the judicial authority mandates the courts
to protect personal rights and liabilities of the parties seeking its assistance. In particular, courts
exist to safeguard people’s rights and protect them against all forms of injustice regardless of the
territory. Hence, states operating under similar laws empower their courts to offer judicial
services to conflicting parties in a move to find a lasting legal solution.
The law presents particular circumstances when courts are restricted from hearing cases
despite occurrence in their jurisdiction. The legal restrictions aim to provide conflicting parties
with the best judicial services regarding the nature of their case to ensure maintenance of justice.
However, the law has no exceptions regarding the territory to determine cases concerning
common legal concerns such as observation of human rights and protection of property.
Following the common nature of laws, both lower and higher courts are mandated to determine
cases regarding liabilities and human rights to regardless of the location of their occurrence or
