Introduction
Punishment is one of the aspects covered by the criminal law that is explained or
grounded on various elements. It is justified with multiple vital theories confirming the
operational services in controlling crimes and offending within the society. Introduction to
prisons and correctional facilities give critical concerns on punishment as the appropriate method
of reforming the potential offenders within the community. The observable development in
incarceration focuses on the changing roles and impacts of prison facilities in controlling
offending within the society (Davis 2018, p. 234). Various theories have been developed in
explaining punishment.
Punishment theories are divided into two general philosophies that are the utilitarian and
retributive viewpoints. From the writings of Jeremy Bentham and Cesare Lombroso, punishment
assists in deterring an offender from future wrongdoing. The penalty for offending should be
severe that would serve in preventing any person from committing similar offense or future
criminality (Newburn 2011, p. 4). Any utilitarianism idea works to punish the offender so at
discourage him or her from such crimes.
On the other hand, retributive theory seeks to punish offenders because they deserve to be
punished. Under the practical viewpoints, laws should apply to utilize the happiness of society.
It is proven that crime and punishment are inconsistent with joy therefore they should be kept to
a minimum. According to the utilitarian thinker, crime-free culture does not exist, but they
endeavor to inflict on the punishment required in controlling future crimes.

Theory of Rehabilitation
The utilitarian approach in the society justifies conditions in preventing physical
conditions that aim at reducing the offending behavior within the community. The criminal
justice system has the set goal of rehabilitation that focuses on the health that offender may
reform or succeed. Reconstruction is identified as the utilitarian rationale for punishment which
aims at reducing the crimes in the society. Rehabilitation is defined as the process of re-
integration into society of a convicted person.
Rehabilitation process dates back to the twentieth century in which kids were treated.
Though the favorability of the process declined in the 1970s through 1980s, it has gained favor
in the recent years. The court systems have introduced rehabilitation processes which confirm the
steps in providing effective treatment processes (Newman 2017, p. 34). Active correctional
operations concentrate on the stages of effective treatment of the crime control processes within
the society.
How Rehabilitation Successfully Handle more Serious Crimes
Rehabilitation process works to control future crime by giving offenders the ability to
flourish within the confines of the law. The primary objective of the program according to the
scholar is counter habitual offending which is also referred as criminal recidivism. The modern
study of penology outlines that offender treatment helps in maintains ties to the outside world.
The theory confirms that undiagnosed people would remain at a high of reoffending thus
increase the need to apply rehabilitation process to offenders. Punishment and behavior
modification aspects do not advance the chances of psychopaths in the society. It is only through
rehabilitation that existing vulnerability of aggressive behavior is treated.

It covenants with the crime on the social context through treating the cause of any
offense. Rehabilitation process centers on the individual subject through focusing on the
offending feelings and the desire of offending. According to the arguments of Bentham,
offenders may not be willing to commit crimes if the reward is so painful. Punishment can either
be specific or general to serve others who may involve in such illegal acts. Such crimes like
pornographic habits among the youths are eliminated through church intervention and education
on the effects of watching such clips (Elliott & Quinn 2017). Offender reformation is the
principal goal of rehabilitation that claims back an individual to the initial productive state.
Rehabilitation theory classifies the process as the central goal of the correctional system.
The goal is set on the ideas that offenders can be treated and returns to their crime freestyle. The
rehabilitation process includes broad arrays of programs including mental health, substances
abuse, and educational services in reforming the criminal behaviors. The measure of critical
aspects of the rehabilitation process is that it addresses the afflictions on chemical dependency,
chronic violent behavior among other practices in the community (Hovane, Dalton & Smith
2014, p. 511). The comprehensive program applies workable education services that equip the
offenders with relevant knowledge to be useful in the market economy. 
Treatment aims at returning productive people to the community thus vast majority
approaches in controlling risk factors to offending in the society. Increasing prison sentencing is
associated with increased rate of re-offending, but the success of reforming the offender depends
upon the programs one passes through while in the correctional facilities (Shaw 2015, p.1382).
Rehabilitation processes assist in placing considerable offender treatment method that increases
the chances of deterring criminal behavior within the society. Those involve in terrorism groups
and radicalized in the society are rehabilitated to good and productive members.

Working towards more effective rehabilitation processes within the society has higher
chances of success in preventing crime and improving community safety. The method achieves
indeterminate rather than fixed sentences to produce ethical behavior on the treatment of the
offenders within the society. Through the offender rehabilitation crimes like prostitution, theft,
and senile degradation are managed as the offenders are placed under learning program and
reformation process. 
The rehabilitation process is currently considered close to the cognitive behavior therapy
which targets range of small crimes. The targets narrow down to the field of crimes producing
control measures to the offending needs within the society. The programs in the community
aimed at changing the personality traits such low control aggressive nature of people, hostility,
and pleasure or thrill-seeking and lack of empathy (Hovane, Dalton & Smith 2014, p. 511).
Substantial evidence reveals that rehabilitation process of offender treatment produces socially
essential educations in re-offending. 
Rehabilitation places an individual to supervisor and monitoring life condition that assist
in correcting the risk factors like the learned habits of gang group. The process deals with the
context of offending which deals with the possibilities of promoting individual positive change
through reforming the personal lifestyle and background. According to Martinson "nothing
works," the correctional approaches continue to fail in the steps of controlling crimes within the
society. Rehabilitation is essential because it reforms an individual to initial productive state
within the community. 
Rehabilitation focuses on correcting severe offenses like psychological disorders which
are cruel and have different impacts on individual health. Treating a particular risk of offending
begins by recognizing the social context and causes. The examination of social purpose helps in

identifying the single weakness thus formulate a workable approach in offering support to an
individual who is at risk of offending.
The program works as an individual or personal level which help in handling the social
challenges that might have acted as the motivating factors to offending. The program has an
evidence-based approach that is useful in treating substance abuse including psychotherapy and
other medical related concerns in the society. Through the medical treatment and psychological
attention to health problems, offender rehabilitation focuses on restoring an individual offender
to more useful state. 
It controls severe offending states like drug addiction- rehabilitation is identified as
restorative because it benefits and brings an individual to his or her highest functioning potential.
The program deals with specific goals set to reach the potential cases of offending within the
society. It begins with the improvement of treatment in keeping an individual track through
maintenance of the instances in effecting care to more aggressive people in the community
(Elliott & Quinn 2017, p. 3). The outpatient programs of rehabilitation help in reinforcing further
progress in learning stages of all the risky offenders. Those under drugs like the street children
are placed on rehabilitation facilities that help in reducing the conditions mental illness. The
treatment assists by attending to health conditions that help in reducing the worst health status
and offering therapeutic steps to control crime mind.
Through this process is assist in saving the resources needed to reform offenders and
achieve the best outcome for the offenders. Through the outpatient programs, more severe
offenders like drug addicts are treated to help in reducing the condition of unwholesome states
through offering medical and psychological improvements of the crime habits. Rehabilitation
identifies the risk, vulnerability and the threats to the individual in the society. From theories of

recovery, punishment serves the corrective approach of handling the hazardous conditions of any
person in the community. 
Recovery process aims at making the offender better before just sentencing is achieved
afterward. Therapy seeks to improve the offender almost necessary subverting the only
punishment penalty. Crimes like murder rape habits can be managed through counseling
processes. Offender rehabilitation focuses explicitly on the conditions of reformation hence
making an individual better not necessarily making them pass through the retributive punishment
process (Newburn 2011). By seeking to improve the offender, the rehabilitation process is
conducted even if no offense is committed.
Conclusion
As of the above-considered perceptions, offender rehabilitation process is the best
approach the violent criminal like the serial killers is treated to a good state. Rehabilitation
process benefits the correctional institutions by ensuring the offender does not commit the crime
again. It focuses on individual offender treatment thus reduces further chances of offending.
Through focusing on the offense, the process deals with reoffending as it restore one to
productive state which is useful in achieving the value of an individual after the justice process.
