Regularization of the Right to Free Migration
Human beings enjoy many rights in most parts of the world today, particularly in the
countries that are stable politically and the ones that practice democracy. The Universal
Declaration of Human Rights is a milestone that has ensured that the fundamental rights of
the people are observed and respected throughout the world (Jones, 2017). There are still
other factors that hamper the enjoyment of these rights such as political instability and
authoritarian leadership in various parts of the world. The steps that the world has taken in
the direction of human rights are significant and have influenced the world in ensuring that
people are protected.
One alarming issue is that many rights are not inhibited irrespective of the country of
residence (Jones, 2017). People can speak; go to religious gatherings, and even dress the way
that they like. Unfortunately, the right to free movement has been inhibited by the various
rules that govern national jurisdictions. It is important to note that someone can even call
another person in a foreign jurisdiction at any time of the day without any inhibitions. When
it comes to movement, however, the so-called national boundaries determine where one can
go and move to at any given time. There are places that people cannot move to because they
are not born in that particular area. However, people from the developed nations do not have
to contend with such an issue as they can maneuver their way across the borders without
having to contend with the difficulties that people from the less illustrious nations go through
on a daily basis. Equality should be something that is universally recognized; therefore, the
right to move should be underscored and practiced throughout the world without any iota of
discrimination whatsoever.
The right to movement is something that should be encouraged and promoted
throughout the world. One misguiding fact is that discrimination is often seen from many
dynamics but the place of origin. Simple movement from one place to another is restricted

and “fictitious” national boundaries are invoked to further the restrictions that are made on
free movement. It is imperative to note that the benefits that have been seen in the
advancement of various rights have come from honest discussions that the human society has
had by looking at the impact of various practices such as racism. It is high time that the same
honest discourses should be held so that the impact and the devious nature of restricting the
movement of the people are discussed, and the matter dealt with conclusively.
It is interesting to note that with the technological advancement that has become a
focal point of the 21
st
century, people are free to share ideas and the same process moves
swiftly, so much so that even real-time communication has been incepted. It is only the
movement of the people that has been limited and restricted to national jurisdictions going to
a great length to ensure that the same does not become encouraged and practiced throughout
the world. When ideas can be shared in that swift manner and decisions made on the same, it
is difficult to see or convince one that the movement of persons is dangerous and should be
avoided at all costs. The movement of the people should be recognized as a fundamental right
that everyone should be allowed a chance to enjoy.
The construction of the society has been in such a manner that the relationship
between the bourgeoisie and the proletariats is strained based on the fact that one group is
exploited at the behest of the other. Marxist theory contemplates that the have-nots are
always exploited and coerced to depend on the affluent for the society to get its balance,
something that brings animosity amongst these dissimilar strata of the society (Brown, 2015).
These ideas that were furthered by Carl Marx years ago are still alive today since the
restriction on the movement of the people appears to be a special preserve of the less affluent
people since people from developing and underdeveloped nations are the most affected. The
implication here is that people from the developed nations have fewer restrictions and they
can move in virtually every part of the globe without having to contend with the same

number of scrutiny that the rest face. It is therefore clear that this is another form of
discrimination based on the social status of people. Discrimination is undesirable in any form,
and as such should not be entertained at all costs. The worrying trend is that the leading
nations should lead the way and dissuade the practice are the ones that have a host of rules
that inhibit the same. The United States, for instance, is a world power that should lead from
the front in the promotion of the rights of the people (Schuck, 2018). However, if the current
developments are anything to go by, then the immigration rules that the current regime is in
the process of enforcing will be the most drastic and negative in the pursuit of the freedom of
movement.
Impact on the Immigrant Sending and Receiving Societies
In as much as the free movement of the people should be encouraged, it is also
imperative to take due diligence and proceed with caution. Immigration is a live concept that
poses a big challenge to the governments and authorities all over the world. People often
immigrate illegally to seek better opportunities in other countries where the quality of life is
advanced. This makes it a big challenge to the authorities in that in line with the fundamental
rights of the people and the advocacy of special groups such as the United Nations (UN), they
have to treat these people fairly and humanely even when the resources to facilitate the same
are hard to come by.
The regularization of the rights of the people to move to any part of the world without
restriction would imply that the immigrant-receiving societies will have to be prepared for
huge influxes. In as much as they would be welcome to go to their favored destinations, the
receiving societies will have to deal with the threat of a burst in human populations and their
resources may be suffocated in the process. On the other end, the immigrant-sending societies
will also have to prepare for huge numbers of outgoing populations, so much so that by the
end of the day, it will be difficult to get the right numbers of people with competent labor,

skills, and manpower to spur development in their jurisdictions. The movement of the people
should not be limited, but even in the process of promoting the same; it is incumbent upon
people to move with responsibility without straining the optimal situations in the host
countries.
